Welcome to Utah Elder Law Blog

Welcome to the Utah Elder Law Blog! My intent here is to provide reliable, understandable and current information on the legal issues that impact Utahns who are aging, have aging family members or friends, or who are in denial about their own mortality, but are nevertheless curious about the legal issues facing "all those old people" out there.

As a member of the National Academy of Elder Law Attorneys, I am eager to help individuals learn about these issues and the often far-reaching effects that the laws of our state and nation can have upon us.

I have been deeply interested in this area of the law since 1995 with the untimely onset of dementia in my own father. I hope to share the knowledge that I've acquired over those years and that I continue to acquire as I serve my own clients.

What is Elder Law? It might best be described as an approach to serving the legal needs of individuals around the age of 50 and older. Of course, individuals in this category have legal needs across the entire legal spectrum. However, some of the more commonly encountered legal issues for this group of individuals include estate planning (wills, trusts, powers of attorney, living wills, etc.), guardianship and conservatorship issues, incapacity planning, business succession planning, medicare, medicaid and social security planning, probate administration, nursing home law, elder abuse, annuity and retirement benefits planning and more.

Although this blog must never be used as a substitute for competent legal advice from a licensed attorney, it is intended to identify and introduce readers to issues that might have never been considered but could nevertheless have a major impact on them now or in the future.

Finally, I welcome comments, questions and criticism from each of you.
